Alabama Permitless Carry โ€” What Changed

Alabama Governor Kay Ivey signed HB 272 into law in 2023, making Alabama the 25th constitutional carry state. The law took effect January 1, 2023. Here's what changed and what didn't:

RuleBefore 2023After 2023
Concealed carry without permitโœ— Illegalโœ“ Legal (19+)
Permit still availableโœ“ Yesโœ“ Yes (optional)
Background check for carryRequired via permitNo check required to carry
Open carryโœ“ Legalโœ“ Legal

Duty to retreatโœ— Not requiredโœ— Not required
Still illegal under permitless carry: Carrying while prohibited (felony conviction, domestic violence conviction, mental adjudication), carrying on school property, carrying in police stations and courthouses, and carrying while intoxicated. Permitless carry is not a legal free-for-all โ€” federal and remaining state restrictions still apply in full.

Why Get an Alabama Carry Permit Anyway?

Even with permitless carry, there are several compelling reasons to obtain the optional Alabama Pistol Permit through your county sheriff:

Reciprocity With Other States

Alabama's permit is honored in 37+ states. Permitless carry only covers Alabama โ€” you need a permit to legally carry in Tennessee, Georgia, Florida (when driving through), and most other states you might travel to.

Firearms Purchase Exemption

Alabama permit holders can skip the NICS background check when purchasing from a licensed dealer. If you buy guns regularly, this saves significant time at the counter.

Legal Documentation

A permit gives you documented proof of your legal authority to carry. In the event of any interaction with law enforcement, it simplifies the conversation significantly.

Low Cost

Alabama's pistol permit costs $20/year (1-year) or $85 for 5 years โ€” issued through your county sheriff's office. One of the most affordable permits in the country.

Frequently Asked Questions

Generally yes, as long as you are not consuming alcohol yourself. Alabama law does not broadly prohibit carrying in establishments that serve alcohol โ€” however, individual establishments can post no-firearms signage and ask you to leave. If posted and you refuse to leave, you can be charged with trespass. The prohibition is on carrying while under the influence of alcohol, not on entering restaurants that serve it.
Alabama does not have a mandatory duty-to-inform law for permit holders. You are not legally required to volunteer that you are carrying during a traffic stop or other law enforcement encounter. However, many firearms attorneys recommend being forthcoming and cooperative. If asked directly whether you have a weapon, always answer honestly โ€” lying to a law enforcement officer creates far greater legal exposure than the carry itself.
Yes. Carrying firearms is generally permitted in Alabama state parks and wildlife management areas (WMAs) for lawful purposes including self-defense and legal hunting during open seasons. You cannot discharge a firearm in a state park except in designated shooting areas or during legal hunts. Always check the specific rules for the WMA or park you plan to visit, as some have additional regulations.
19 years old for permitless carry of a handgun. This is set by Alabama state law. Note that federal law sets 21 as the minimum age to purchase a handgun from a licensed dealer (FFL), though private sales between Alabama residents can be completed at 18+ under state law. For long guns (rifles, shotguns), the federal minimum purchase age from an FFL is 18.
